Recently, there is a proposed bill in Congress to create a new department for OFWs, migrant Filipinos. President Rodrigo Duterte even took his support for this legislation creating a new department for overseas Filipinos further by certifying it as urgent. The measure, pending at the Senate as Bill No. 2334, seeks to create the Department of Migrant Workers and Overseas Filipinos (DMWOF).

The newly-created Department of Migrant Workers is expected to start operations by 2023, the Philippine Overseas Employment Administration (POEA) said on Thursday.

“They have a so-called transition period, two years have been given by law for the transition of agencies to the new Department of Migrant Workers and during this transition period, a transition committee will be formed,” POEA chief Bernard Olalia said in a Laging Handa briefing on Thursday.

Olalia said the committee is tasked to craft the implementing rules and regulations (IRR) of the department, the organizational structure, and staffing pattern.

The committee will also submit a budget proposal for the department for 2023.

It will be composed of officials from the POEA, the Undersecretary for Migrant Workers’ Affairs or UMWA from the Department of Foreign Affairs (DFA); Philippine Overseas Labor Office (POLO(sad) National Reintegration Center for OFWs, National Maritime Polytechnic (NMP), all under the Department of Labor and Employment (DOLE); and Office of National Social Welfare Attaché (OSWA) from the Department of Social Welfare and Development (DSWD).

“The purpose of this department is to expand the assistance they should receive and expedite the delivery of services to them, to unite all our agencies, our inter-agencies that have a mandate for the protection and promotion of our OFWs,” Olalia added.

Aside from these offices, the Overseas Workers Welfare Administration (OWWA) and International Labor Affairs Bureau (ILAB), both attached agencies of the DOLE, will also be part of the newly created department.

On the other hand, Olalia assured employees of these agencies should not be worried as they will be absorbed by the new office.

“All the personnel, all the resources, your budget appropriation will be combined. And don't worry, the employees or staff of the said agencies because they will be assumed. There will be consolidation and merger of all these agencies,” he said.

“It is clear from the provisions of the approved law that all the appropriations and budgets of the agencies I mentioned earlier will be the budget of the new department,” the POEA chief added.

The creation of the new department is pursuant to Republic Act 11641 signed by President Rodrigo Duterte last December 30.

The Department of Overseas Filipinos is envisioned to better assist in improving the lot of 10.2 million overseas Filipinos in more than 200 countries and territories. Of the 10.2 million Filipinos abroad, 4.8 million are permanent migrants, 4.2 million temporary migrants, and 1.2 million are irregular migrants. There are also 2.2 million overseas Filipino workers (OFWs), based on the 2019 Survey on Overseas Filipinos by the Philippine Statistics Authority. 


Skeptics had said a new department for OFWs would simply be a duplication of functions and was unnecessary. But the measure promises to deliver better government services to OFWs and Filipinos abroad.


The bill would transfer all functions and mandate of the Philippine Overseas Employment Administration (POEA) from the Department of Labor and Employment (DOLE) to the DMWOF.


If passed into law, Senate Bill 234 would turn the Philippine Overseas Employment Administration (POEA) into the DMWOF, with the mandate of overseeing all policies protecting the welfare of Filipinos abroad.


The functions of the following offices under existing departments would be merged and transferred under the DMWOF:


  • National Reintegration Center under the Overseas Workers Welfare Administration (OWWA)
  • All Philippine Overseas Labor Offices under the Department of Labor and Employment (DOLE)
  • International Labor Affairs Bureau under DOLE
  • National Maritime Polytechnic under DOLE
  • Office of the Undersecrertary for Migrant Workers' Affairs under the Department of Foreign Affairs
  • International Social Services Office under the Department of Social Welfare and Development
  • CFO under the Office of the President


Meanwhile, the OWWA would be an attached agency of the DMWOF.


Under SB 2110 filed on March 24, 2021, the Department of Overseas Filipinos will subsume all the powers and functions of the Office of the Undersecretary for Migrant Workers' Affairs of the Department of Foreign Affairs, the Commission on Overseas Filipinos, all Philippine Overseas Labor Offices and the International Labor Affairs Bureau under the Department of Labor and Employment, the Social Welfare Attaches Office under the Department of Social Welfare and Development, and the Philippine Overseas Employment Administration.


The Overseas Workers Welfare Administration will be attached to the proposed department for purposes of policy and coordination.


In the House of Representatives, House Bill 5832 also known as the Department of Filipinos Overseas passed the final reading with 173 votes in March last year.
